Terms of Service

1. Who we are

These Terms of Service (“Terms”) govern your use of the RMF Sonics website, accounts, and software (including RMF Visualizer and related plugins) operated by RMF Sonics LLC (“RMF Sonics,” “we,” “us,” “our”).

By creating an account or using our services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not create an account or use our services.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to online services) to use RMF Sonics.

If you are under 18, you represent that you have permission from a parent or guardian.

3. Your account

• You provide a valid email address and a password when you register.
• You are responsible for keeping your login credentials secure and for activity under your account.
• Notify us at support@rmfsonics.com if you believe your account has been compromised.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.

We use email to send account-related messages only (for example sign-up confirmation and password resets). We do not send advertising email without your consent.

4. Beta program (RMF Visualizer)

When beta signup is open, you may request access to pre-release software. Beta access is invitation-only and subject to our approval.

If approved, we may issue you a personal beta license key. That key:

• Is for your use only — do not share, sell, or publish it.
• May be revoked at any time (for example if beta ends, if you violate these Terms, or if we deny or withdraw your application).
• Requires the app to check in online periodically (currently about every 30 days) to remain active.

Beta software is provided “as is.” It may crash, change, or stop working without notice. Do not rely on it for live performance, client work, or critical sessions unless you accept that risk.

Feedback and bug reports you submit (including via our Discord /bug command) may be used to improve our products without compensation to you, unless we agree otherwise in writing.

5. Purchases (when available)

Some products may be sold through our site using Stripe. Prices are shown at checkout. By completing a purchase you authorize the charge and agree that:

• Digital goods are delivered electronically.
• Unless required by law, all sales are final once access or download is provided.
• We may update pricing or product availability at any time before you complete checkout.

Receipts and purchase history are tied to your account.

6. Acceptable use

You agree not to:

• Share, resell, or publicly post beta license keys or installer download links meant for you alone.
• Attempt to bypass licensing, rate limits, or access controls.
• Reverse-engineer, decompile, or tamper with our software except where applicable law explicitly allows.
• Use our services to violate any law or third-party rights.
• Scrape, overload, or disrupt our site or APIs.
• Harass our team, other users, or community members (including in Discord).

We may investigate abuse and cooperate with law enforcement when required.

7. Intellectual property

RMF Sonics LLC, RMF Visualizer, logos, site content, and software are owned by us or our licensors. These Terms do not sell you ownership — they grant a limited, revocable license to use the software according to your purchase or beta approval.

You retain ownership of content you create with our tools (your music, sessions, etc.). You grant us a license to use bug reports and feedback you voluntarily submit.

8. Third-party services

Our site and software may interact with third-party services (for example Supabase for auth, Stripe for payments, Discord for community/bug reports, and GitHub for issue tracking). Your use of those services may also be subject to their terms.

We are not responsible for third-party services we do not control.

9. Disclaimers

To the fullest extent permitted by law:

• Our site and software are provided “as is” and “as available.”
• We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted, error-free, or secure operation.

10. Limitation of liability

To the fullest extent permitted by law, RMF Sonics LLC and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of our services.

Our total liability for any claim related to these Terms or our services is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.

Some jurisdictions do not allow certain limits; in those cases our liability is limited to the maximum permitted by law.

11. Changes

We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date. Material changes may also be noted by email or on the site.

Continued use after changes take effect means you accept the updated Terms.

12. Termination

You may stop using our services at any time. You may request account deletion by emailing support@rmfsonics.com.

We may suspend or terminate access (including beta keys) at any time for violation of these Terms or for operational reasons.

Sections that by nature should survive (disclaimers, liability limits, intellectual property) will survive termination.

13. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules.

Any dispute will be brought in the state or federal courts located in Colorado, unless applicable law requires otherwise.
